i nearly got arrested at subway ordering a sanga and joking around with my mate... i just happened to look out the window with a big grin on my face and notice 3 coppers looking at me.... i kept looking for an instance too long and they entered the shop and started harrassing me, did a background check on me, searched my pockets and wallet and was almost about to invite me for a ride to the station all because i looked at them and was smiling

i could have made complaints about them but i figured it would just cause me more sh1te in the long run so i just had to cop it sweet.... hurray for the po po

That patrol car seems to have some expensive looking wheels and low profile tires payed by the tax-payer. Figures.

About 13 years ago we where tailgated by some jacks for a while coming back from our farewell party as we where going to Japan for work. As we turned into our street and hit the roller door button the lights came on, we indicated to pull to the left and luckily we where 10 metres away and went straight into the garage and hit the close button on the way in.
They knocked on the door and seemed mighty pissed that we wouldnt answer the front door. We couldnt help rupture in laughter at times as we where trying to be quiet. We left the following week but stored his car at a friends place as we cancelled the rent .
We where very lucky and proud also how it happened.
If youre an idiot in a modified car and get caught eat it.
If not, its handy to have a roller door and be just about to pull into it if you get flashed.

A friend of ours has an out of control teenager always in trouble with the popo. On a call out for the kid typically hitting into his brother, the cops decide to put a canary on her corolla. Nice work boys. She can barely afford rent and has 2 teenage boys and a dipsh1t ex that won't provide a cent and this is how they repay her.

They are trespassing but most people dont understand who they are and where they stand. These criminals have no right on your land even with a warrant they have to prove that it was signed in wet ink and not a photo copy which is usually the case and most dont know this information. Dont talk to them or confess to anything they cant touch you if you know they only allege everything, nothing concrete.

Just so people know the Police are a private corporation registered in Washington and have no rights over you they are all criminals working for paedophile freemason inbreds.

They are operating as foreign corporation and you must learn equity law, Glossa/Dog Latin so you can easily dismiss their war criminal intents as that is all they are, parasites of citizens stealing anything they can from you.

Yeah in QLD you front court not defects now, laws came in effect as of 1st of July do a search and find out thats why it surprised me that they gave you a defect....

Anyways I think it's a load of crap that they busted you but I think they saw the oppurtunity to bust some one, I like how they had 2 vehicles there (the highway patrol and cop bike)

Police might need a warrant to search a car. But they dont need anything to inspect a registered car to see if it is road worthy.
There is a big difference.
They may even need a warrant to inspect a car on private property.
But if they want to inspect it to see if it is road worthy, they will eventually do it regardless.
How ingnorant the vehicle owner acts will greatly affect the extent of the inspection and whether or not its just an on the spot inspection.

Thats the joys of modifying road registered cars.

Phunks 100%, they don't need any form of warrant to top to tail your car, even if they were searching for drugs. The fact yours was running gave them sufficient reason as it 'may have' been driven.

At Summernats this year we saw the WILDE1 VK defectd on it's trailer. The cop pulled him over saying the plates were registered to a VT, which they never were, but once he was pulled over they were on it. Defected because he 'could' have driven. His response was if he was gonna drive it on the street he wouldn't have towed it.

Problem here was he had plates on, and cops are in their rights to defect any registered car regardless where it is. Moral is if you modify your car you gotta learn to live with it, and if you're towing it take the plates off.

well here is my 2 cents and i do have a law degree which helps.

I am not aware of any statutory or common law right that gives police power to enter private property in order to search a car. They may only enter private property to effectuate an arrest or with a requisite search warrant. Of course once they enter your property without a warrant or to effect an arrest any evidence collected from that point on is tarnished and will not hold any probative value in a court.

The sad fact is that should the police be thrown off the property, it would take a very brave man to drive either of these vehicles on the street again.

Once the word was out, the mere sight of one on the public road system, or even parked in a public place [car park] would be enough to bring down the SWAS team [Aussie version of SWAT]. If the vehicles were in motion, then I shudder to think of the possible traffic violations that would appear on the infringement notice.

You did the best possible thing. Just step back, let them go & cop it sweet.

The simple fact is that the law says that in order to be granted registration & permission to operate on the public road network, the vehicle must comply with the requiremants of the motor traffic act. If it doesn't, then the cops are obliged to act, particularly if they are in receipt of a complaint.

You can thank your brother for dragging his arse, making sparks & generating a complaint that drew the heat. You just turned up at the wrong moment.

The Cops have someone who reads through car forums.

I dont think so champ. I believe over a period of days police attended to this house trying to contact the owner of this vehicle. Even then only a motorcycle cop made initial contact. Highway Patrol was then called to carryout the inspection like they do in every other instance of a vehicle being defected.
Good Story though.

Ah, but they can enter if you allow them. 'Excuse me sir, mind if we take a look over your car', 'Yeah sure officer'. Now they can do what they wish.

Also, if they have suspicion of illegal activity, such as following up a complaint of street racing or burnouts, then they would have the right whether you like it or not. If you challenged it in court they could just call on their witness statements (and if they know where you live someone obviously caught a number plate).

Not trying to be rude mate, but giving out legal information like that can be dangerous for uneducated people. You would know better then any of us just how many grey areas there are in the various levels of law in this country.

I wouldn't have thought that they could do that. If it's in your garage then there is no way of telling if it's been driven or not. I mean think of all the crazy custom show cars etc that are road registered sitting in driveways all over the place.

Sp that means if i was working on say tubbing my ute and playing round with it to see how low i could get it to sit in the arse end and the cops swung by they could defect me cause it's still road registered!!!

That's just ridiculous!!!!

Got no time for the long arm of the revenue raiser Funny how they don't sit outside the carpark of the pub and breath test people sitting in their car ..... easier to hit up the soft targets. Can't wait until I get a roadside EPA noise check on my GSXR or one of those blanket pull em over and check for "Unleaded Fuel Only" stickers on the tank ........... There will be a blow up for sure
Driving a car that is defectable - fair game,
Sitting in the driveway with a cold engine - police state and they can get @#$% (warm engine from being chased home might be a little more difficult

Just be thankful the out come isnt like your brothers ute. His attitude of "shit happens" is the only way to look at it. A warrant wouldnt make any difference. If they want to go over your ute, they will find the time and place just like how they were persistant with your bro.
