Guys,

I have been reading up on a few old Topics regarding this but it seems as if this question is still in limbo.......

Im looking at purchasing a 2l turbo set up (FJ20) in a 1200 ute from ACT and wanting to engineer it in NSW... Is this possible>>?

Ok Guys here are a few key points to clear any issues raised:

* There was an offer made by my mate.
* There was acceptance by the seller which mirrored the offer.
* A deposit was offerred by the buyer, however the seller didnt feal comfortable with giving out his bank details..
* When the acceptance was made by the seller the plane tickets/pik up truck/hotel was organised by the buyer.
* The night before he was to leave for the airport 45USN called and said along the lines of "I was just out driving my car and a guy is really keen on buying. I feel like a c%$#t but this guy is really keen, i know we had an agreement but this guy wont stop hassling me for the car, he really wants it."
* My mate replied along the lines of "Well we had an agreement and the car was sold to me"
* Subsequent to the offer and acceptance by both parties the buyer organised plane tickets/hotels/pik up trucks etc.

Hope this clears all issues.

In my opinion the answer to this is quite simple;

There was an offer, there was an acceptance, there is a contract, the contract was breached by the seller, the buyer should be compensated damages which includes costs that has arrisen due to the contract being made. Its not only morally wrong but legally wrong!!!

Thanks for your helpfull feedback guys..

Frodaddy and fat14's you both sound like you know how to handle such a case and I have shown my mate all of your comments. My mate is still really fustrated at the moment and due to this guys actions.

Ill let you know what he intends to do with this low act carried out by 45USN.

I suggested he speak to his solicitors and go from there but at the moment he is still not completely with it.

Some of you guys where asking how can he prove that he was intending to buy the car and the car was sold to him ... well... im no enstein but couldnt he prove this by;

1) Showing receipts for 3 return plane tickets to Brisbane/Sydney

2) Booking details of the TNT truck (which includes 45USN home address.

3) Phone records (he called him every nite for a week).

4) Annual leave forms from his work and mates work.

5) Showing the cheque to the courts made out to 45USN (his full name on cheque)

6) An agreed time/place to pick up and price with 45uSN and my mate.

Now your telling me thats not enough information/proof that the car was sold to my mate>>??? If the car wasnt sold to my mate why would my mate have all his personal details>>??

This really gets me frustrated could you imagine my mate.... The thing is his been saving for ages and always liked this ute... Its heart breaking!!!!

Frodaddy - It seems like you know heaps about this kinda thing a might have to put him in contact with you.

He should be getting back tonight, im not sure if he paid him a visit or not ......

An offer and an acceptance was definately made!!

When guys do business like this it really turns you off private sellers (the shonky ones anyway)!

Fortunately it is the minority of sellers who take on this mentallity..

Just WARN everyone cause it could happen to anyone!

L18_b110 - No! the buyer offered a direct deposit be made in his account but the seller insisted that there was no need for a deposit and that my mate shouldnt worry because the car is considered sold.

If someone was selling a car in Brisbane and you agreed on a final price and told you that a deposit was not required and insisted to you that the car is yours and come here to pick it it up wouldnt you be pissed off after spending $1000 on flights and transport ????? Geeze I know I would be and I can tell you now that the owner of 45USN is a DOG ASS !!! for doing that.

They had organised a date time and place to pick it up and then my mate gets a call the nite before and the owner says sorry. Well to me thats bull*%$it.

Well I just spoke to my mate and he flew up this morning seeing as he didnt want to waste his tickets.

My mates got his address and his not sure wether he is going to see him or not.

The stupid thing is that everything was agreed on price, time of pick up everything...

Well spread the word that this guy is a complete dog ass and beware if buying a vehicle of this bloke in the future WARN everyone!!!

My mate didn't tell me how much he agreed on but im sure I will find out soon.

My mate was asking me the same question wether he can take this legally or not. As for phone records he called him everynite for the past week organising the pick up and payment arrangements.

WARN others cause he is also trying to sell a BA XR6 Turbo on car sales.

What do you think he should do?????

Some of you may know that Red Ute for sale known as 45USN.

Well a close mate of mine in Sydney agreed on a price with the owner of this car in Brisbane earlier this week.

It was always agreed that the car would be picked up on Saturday and therefore my mate booked 2 plane tickets to Brisbane and also organised for a TNT delivery truck to be there. This would cost some $1000...

Anyways the owner called him 2nite and said sorry but he sold the car to someone else!!!

Now to me that is a complete dog ass and if a car is sold well its sold!

For anyone that knows the old or new owner of this car 45USN please let them know that they are complete dog ass's for doing this, and guys that are looking to purchase a vehicle be aware because unfortunatley there are loosers like this out there!!!
