Dude you said it, "dumb asss bastard" not me.
For some reason you got stuck on a animal as a metaphor and looked straight past the actual facts.
No one is doubting Bul33t's mates story. The fact is he has no actual proof that an agreement took place. Thats the biggest key to proving it.
No one is asking for proof. But a Judge wont go on word alone.
End of story.

I am glad your life beats being me. I would never wish for what I go through mentally day to day on anyone. ( And I dont mean stress )
I am also glad I am not anything like you also. Combine your not thinking things through with what I personally have to cope with and I am sure I would no doubt put a bullet in my head as a fix.
Be thankful your life is as good as it is.

anywaysback to the point at hand.........

obviously there was a "moment" that occured where by the "buyer" was told by "4susn" that the car is sold and that he should not bother cuming to queensland ....as i have read this happened when the "buyer" rang the nite before to confirm everything............so there MUST of been a "moment" where "buyer" has said....hang on #### head after all this talking and after i have booked all my flights an everything....you cant just do this to me......blah blah blah........what i wanna know is ..did this conversation happen???? and if so what did 4susn say ......cause his next few words he said contribute heaps to all our comment on the forum here....
...u really need to talk to him and see what he has to say for himself....


as far as i gather ......if all the phone calls were made and all the organisation had actually happened........"4susn" would have a consideral amount of guilt hovering over his head as we speek ......and by no doubt has read this thread a million times by now........

he knows EXACTLY what he did

Hey I didnt bother to read everyone elses opinions or thoughts but did read the original post an thought I would just make these comments.

1. The new owner cannot be blamed for purchasing his car from someone that puts now value on his own word. The new owner likely just bought the car for the reasons we all do.

2. I do not purport to be a lawyer and since I live in Canada it may be different elsewhere but, my understanding of Contract Law is ....

There must be OFFER and ACCEPTANCE and something to BIND the deal. So if a person offers an amount and someone accepts that amount it is still not considered a contract. BUT.... if the purchaser gives a deposit of some value, (example.. hands over $200 cash or cheque as a deposit), Then you have entered into a contract. So... if the purchaser bails he loses the deposit but the seller has been bound to the agreement.

It is always best to get these agreements in writing and have a record of any deposit though. Remember boys and girls....

CAVEAT EMPTOR - Let the buyer beware !!

Even if the contract was proven, what could the courts do? The car is already sold, are they going to make the seller build an identical car and sell it?

Personally I never go into any agreement with anyone about a car. The car changes hands at the same time as the cheque. THATS common sense!

If I told someone that I would hold the car until a certain date I would do it, but thats because I'm a nice guy, not because I'm legally binded to do so.

I see your guys point of in the real world, but an oral agreement does not have to be recorded. It is hardly rebutted that there was not an agreement but instead that 45USN was not intending to be bound. This is why this evidence would probably be reasonably compelling.

Also, the car is worth more than $7500 (From what I have heard) and legal counsel is available. Plus one can always get legal advice before their respective hearing at the tribunal anyway.

The matter may not be heard in QLD. It is where the contract was made ( where acceptance occurred). This could be in NSW if there was negotiating and BUL33T's mate accepted an offer/counter-offer etc.

Off Topic.

I used to fitout police cars for Car Tech Services. I mainly done Highway Patrol fitouts ICV ( In Car Video ) And while the camera's record all. A mic on the Patrolman's belt relays all sound to a hard drive in the boot of the patrol car.
Not that saying what speed you had done could bring you any grief.

I personally am into personal debt collect type way, if this happened to me I'd go see the guy and see what he says and if he didn't pay up for my incurred costs I roll him. Plain and simple.

I know people are gonna go blah blah you can't do that you'll end up in more trouble blah blah, but in the REAL world, after you've flogged someone up and induced fear they keep their mouth shut.

It's always last resort as people who F you over need to be taught a lesson.

But in your mates case I think I'm with harry on his thinking, to me there is absolutly NO possible way a verbal aggreement can be a legal binding contract unless you have recorded it.


He has alot of evedence but think of it in this senario, he rings him and says I want your ute and he says nah I'm in negotiations with another bloke, but then your mate really wants this ute and keeps ringing him (every night) asking him if he could buy it.
Then lets say your mate gets to obcessive and organises a trip up and the payment and car moving company, to try and entice the seller into selling it to him. but then the seller finally says NO I've sold it.

By rights he could produce exactly the same evidence as what your friend has now but the whole way through teh seller was saying no.

It's the same as cops if they catch you speeding and then you say to them geez I'm glad you caught me now and not 1km back, then the cop says why's that, and you reply because I was cracking 200km/h. the cop can't do #### as he has no proof that you did even do that or even said that.

But I hope your friend gets a little compensation out of it
