Like i said Milan,if you don't fight this and win,you are going to lose your license and all because some cretin does not know the law!
As Dodgeman has pointed out the rolling radius of the factory supplied tyre and the 13" tyres you have on board is 2mm differance and well within Queensland transport requirements. As for the mirror, get a breakdown of the A.D.R. numbers on your firewall plate and read what the car was originally rego'd with,in the mean time get a solicitors advice

Hey Bert,

Thanks heaps, i am going to check A.D.R numbers on my firewall. I am going to also see a soliciter this week and find out about this fine.

The only problem is and my dad confirms this, my door trims, mirror and wheels i can contest and more than likely win. but the problem is i didnt have a heater box and the car does come standard with a heater box.
And the problem that i face with is the defect fine is for all those items not individual, so for me to contest that fine and win i would have to win on all points including heater box.

I will consult my solicitor anyway and see how it goes,

Thanks for your advice and help!

Alot of older cars and even modified cars do not have a heater fitted. Up until 1970 a heater was sitll an option in a HT holden. What you do need is a demister for removing moisture from the front windscreen. All the old holdens had was a vent/demist lever for cold air to hit the windscreen. Acceptable in Vic. Qld?

yeah i see what you are saying but one of the things this transport inspector told me when i was pulled over was, my car came standard with one so it must have one.
The reason he knew it came with one was he checked the numbers on the plate and guess what heater was one of those digits.

I rang some wreckers too and no one has a heater box for a 1200. So if anyone has one let me know please.

Cheers
Milan

Man oh man, I know theres got to be thousands of wonderful things about your country but this system sure isn't one of them.

If cops is the US pulled people over to check tire ratings & size they wouldn't have any time for coffee & donuts! I'm amazed they have the time to pursue this on you guys at all! If they started making the cops here do checks like this the cop would raise holy hell about having to do it.

The State Patrol (police responsible for all interstate highways) check truckers all the time for safety issues(tires, loads, lighting, etc...) but unless the car going down the road is a serious POS spewing dense blue or black smoke with parts dragging & falling off they don't bother you here...... aside from speeding, that they pull you over for!

Good luck battling with the bureaucrats.

hey guys,

I spoke to queensland transport today and they advised me as long as my car was not built with a passenger side mirror i do not need to put one on.

Can someone confirm 100% that my datsun 1200 ute 1979 model was never produced with a passenger side mirror, or tell me where to go to find this information out?

Thanks in advance for everyone's help

Don't know if this'll help, but I have a '79 ute and the mounting holes for the side mirror on the passenger side were filled in (not by me). This leads me to believe that this model came fitted with both L & R side mirrors. That is, unless the door is from an older model ute.

If it were me I'd just fit another side mirror. Go to the wreckers and grab some Sunny ones (they suit quite nicely). I doubt you'd have a problem with the rim issue.

Also, in our great state you don't lose the points on your licence until you pay the fine. Therefore you could get your 'opens' and then address the defect and maintain your licence.
