Fortunately, it would seem that the 'at fault' driver in your case is insured, so you will at least get something.

Sadly, there are those who are not insured, or who think that they can get away with it while driving cars that the insurer can refuse to pay out on due to non compliance with the insurance conditions.
Sometimes we think these people are our friends but when it comes to the "crunch", they are not. Illegal cars do not do the rest of us any favours & only give the insurers, the cops & other authorities an excuse to give the rest of us grief.

This apparently happened only last night [24/4/08]

The problem is 90% of companies assume ownership of the wreck if they pay you out for a write off. If that is the case with the other drivers insurer then it probably will end up as scrap. They may send it to an auction house, if they do you can get the details and buy it back on the cheap (hopefully).

It sucks that the specialty insurers don't insure drivers under 25. Just because your 19 doesn't mean you don't appreciate a classic ride. I think it's an excuse to keep their premiums low or something.

dont forget its HER insurance that will pay for it not yours, you can dispute with her insurance that it must be repaired and not just a cash pay out.

sorry to see it mate, the same happened to me in my 12 coupe i had few years ago... wet weather an stupid 50yr old lady in a brand new mazda..
wet weather and a dodgy road in adelaide did not help...

the only thing wrong with shanons for me is im 19 and they only take people who are 25 and over i think.. i called a year ago and thats wat they said?

thats wat i thought its not like new cars were you can wack a plastic gard on, you have to make it all metal panels. i think that its going to cost more to repair or it could be just be a right off and i could be the next project haha.. i'll have to wait and see wat the turn out is.. but i will never give it to the scraps i'll find sum way to get her back!..

very sorry to see that... I hope all goes well. Having been not at fault in an accident in my old BMW, I'd say her insurance company is going to be a total pain. At least you have comprehensive so your insurance company will go in to bat for you to cover their costs.

I had 3rd party fire and theft only, so as I was not at fault my insurance wouldn't do anything - their insurance wrote my car off, and only gave me $1650 when the book value for my car was $4000, and they would not take into consideration that the car had a fully rebuilt engine + many hard to get/ desirable extras on it. I got my wreck back, and repaired it on the cheap, but the car was never the same.

Sounds like Shannons is far more understanding than most, and once I finish restoring my 1200 I think I'll go with them. Good luck!!

Mines insured for $3500 with Shannons, so luckily if it was written off I'd get to keep it.

my ute is insured for what I bought it for, though it has already cost me about $4k in extra expenses, next time I insure it, I will up the figure. Its also the extra that hurts the most. I also dont think that I could find anyone willing to part with a ute in similar condition.

Agreed, $3K just doesnt cover much in terms of comprehensive insurance. In saying that i covered my ute with NRMA for $5k just so i dont end up without a Datto if it gets whacked. I figured that if it ever comes to that i wont need more than that to find a similar condition vehicle.

I'd hate to say it, but unless you're insured with Shannons you won't have it for much longer. Write-offs are for damage over 75% of the value, I reckon that'll cost more than the agreed value.

All that work will be good old fashioned panel beating, can't buy any of those panels new. I hope for you I'm wrong, because that sedan deserves better than scrap.
