Yes its new but you'll get one of those with store warranty for that price, on top of the apple warranty.

9 times out of 10 apple will simply tell you to get an exchange from the store so their warrranty is a bit useless.

yeah no offence taken and good point, but I've never seen a second generation ipod come back for repair, the only times I've seen them back is people who have no understanding of the concept of Mp3's or are computer illiterate. The only problems with the first generation ipod's were their battery (needed to be replaced sometimes withing the first 12 months)

But apple are quite anal about their products and yes you must obtain a return autority off them before your sellre will take it back otherwise the seller is then left with a product that apple won't touch. For anyone interested I could probably get a legit reciept for it so warranty would still be all good!!!!
