To the Manager (Infringement Processing Bureau),

I am writing to appeal the issuing of the Penalty Notice M 50962**. The officer who issued the ticket refused to listen or acknowledge the circumstances surrounding the incident and as such I feel that I was unjustly treated. The officer gave no indication that he understood or wished to understand the circumstances even though they should have been relatively clear at the time. damn straight thats total udder bull #### fukin pigs! id say the prik just didnt like datsuns im not sure but i dont think u will get away scotch free... my mums a volunteer police officer and she knows her ####... but i doubt that u will get away with it because id say they will ask u why u just didnt stop on the highway across the road from the servo...good luck any way i think its bull #### that fine

Hmm. Hope you don't have to pay the fine, but I think they (Police) are just out there to pick on anyone doing anything out of line. Do they get payed by quota or something cause they really don't give a damn. Maybe reply with expensive instead of very , cheap electric fuel pump, Cause the 1k is a Classic!! (Over 30 yrs if I'm not mistaken.)

Well, I don't know much about the legal system over there, but that fine is very clearly crap. Like I said, I don't know much about your legal system, but here in the US that would never stand up if you took the ticket to court.

And they wonder why the cops have a bad reputation. Add to this the fact that few days ago (maybe 1 and a half weeks) we had a brawl out the front of work and we rang for the Police. Our security tried to break it up and about 45 minutes after we rang, we called again to tell them thanks for bothering to show up (!!!) as it had practically dissipated. That was about 2am on a Thursday night. They have enough personell to pull over a car on a deserted road at 1am but not to break up a brawl with about 8 to 10 guys spilling blood all over the road.

Lets not get started about cops though... Might end up being fined again.

Yeah i got defected in Kings Cross, Sydney the other day (a place notorious for car cruises, however not at midday or when im on my way to work), ended up getting the notice cancelled due to poor police work, if you know your stuff fight as i only pay about 10% of all the fines issued to me. This Defect was for 'Loose Batery', he seemed to miss that i only have one seide mirror, no passenger seatbelt,and a loose passengers seat. I recified the problem, but the officer did not put his Police numbe on the form or give me both copies of the notice, so cancelled it was.

You should just challange the fine at court. there should be an option on the ticket. Usally the officer wont waste his time coming to court on a $178 fine which means you win. but if he does and you give ur evidence to the court and are found that the officer was correct then you could get told to pay the fine and have to pay court Fee's etc, so could end up costing more.

But if you think you have a good case then yeah go for it.

Also Jack i think your at UNi right? My uni (jcu)has a deal with one of the major Law firms locally and the deal is that Uni students get a free 20minute consultation time for any problems such as yours.

so inquire at your UNI and/or talk to a law lecturer in the LAW deparment, they always usally help with this stuff

I don't know, have you sent the letter yet? ... you ran out of fuel ... you made an illegal u-turn(?) ... you imply in writing that you are very familiar with running out of fuel (or nearly out of fuel) making it sound like a habit of yours ... I doubt if the court will have sympathy.

On the other hand, since you made it off the street, why didn't the officer fine you for the u-turn instead of running out of fuel? I would think about (truthfully) denying that you ran out fuel on the public street. After all, the car wasn't on the street, the officer gave you the ticket at the fuel station! Maybe he was doing you a favor by giving you a less expensive fine?

i think he was fined for the illegal u-turn, and the name of the thread is somewhat sarcastic.

that's not how it works unfortunately. In QLD anyway. If you elect to have the matter heard before the courts, you will be notified of the date. You turn up at 9am when the court opens and sit around waiting to be called. You then plead not guilty. The Police officer is not required to be there at that appearance. That's all that happens at that time, and you will again be notified of the date the mater will be heard. So that's half a day off work for nothing.

At the hearing, the officer in question and his partner will turn up, complete with transcripts of the micro cassete that was in his pocket at the time, and copies of the report he and his partner completed at the end of that shift. And they will be accompanied by the Police Prosecutor who will have a copy of your driving history. You will only have access to those documents if you make a formal request for them. All those documents are presented to the Magistrate. Even if the officer is unable to show up for the court date (rare), the Police Prosecutor will provide all those documents and the matter will still be heard and decided.

After the nature of the matter is explained to the Magistrate in summary by the Police Prosecutor, the Magistrate will ask you for your defence. Now, I'm no expert but
I don't think the traffic act makes provisions for road rules to be broken if you are running out of fuel! The Magistrate will probably decide then and there that in fact did perform an illegal u-turn as attested to by 2 Police Officers and not denied by yourself, and not even give the Police Prosecutor his go at x-examining you. That's all they are going to be interested in - wether you performed the u-turn, not why.

Save yourself the extra $50 and 2 days off work and pay the fine.

oh, I forgot to mention that the duty solicitor at the court who is there to help/advise people representing themselves, will not assist in traffic matters.
