So, correct me if i'm wrong here, but the only time you would offer more than asking price, is if you were knowingly trying to screw over a legitimate buyer [at the asking price] before the cash changed hands.
Would that about cover it?

The least the seller could have done was tell datsmokin that he had been offered more. I know it may have started a bidding war, but it's common courtesy.

Well something is not sold until the money is in the sellers hand, i just missed out on 13 million worth of commission after a deal was aggreed and then we were under cut.

Agreed man, but we don't know the circumstances. If the first bloke agreed to buy it and the seller told him it was his it's a bit rough to then tell another bloke someone has agreed to buy it for $350 but he can have it if he betters the offer. If he wanted to sell it that way he should have put it on eBay.

It is a good point to remember that verbal contracts are legally binding. In your case maybe take a tape recorder to meetings. I know it's poor form, but so is the company going back on a verbal agreement with you.
