To All Members,

Be very careful if you buy anything from a member of this site who goes by the handle ADE. I purchased what I thought was a Sunny 5 speed box off him last year for big dollars which sat in a crate for a year while I got together other pieces for my diff conversion. Imagine my surprise when after it was installed last month that it did not have a 5th gear, it is in fact a standard four speed box!!

I was hoping he would be reasonable in refunding part of my money but instead he runs off to the Lawyers who reckon that he doesn't have to give me back a cent. Pretty low and dishonest. I hope you sleep at night mate.

Apparently I have a perceived problem, pity no one told the gearbox that!!

Ade seems to be and is what i believe to be a good bloke. I could not see him doing this on purpose. Maybe he really felt it was a 5speed packed it up and shipped it off to you. I can understand your pain too. I wouldnt be happy at all if this were true. However as the buyer you probably should have given it a once over as soon as you received it. Right then and there you would have found out it was a 4speed and im sure Ade would have humbley appologised and refunded your money. The money should be returned or a agreement made but its also hard for someone to pull that $500-1000 out of there back pocket which they thought was theirs and spent during the year.

Its too hard for anyone to really comment though without knowing all the details.

PS. Are you sure it isnt a five speed that is worn or broken something not allowing 5th to be selected?

I didn't check the gearbox because I took ADE at his word. I opened the crate, it looked good and I put it away for 11 months, perhaps a mistake I made which ADE and his Lawyers hang their hat on for not refunding me. Sounds like a pretty honest and reasonable bloke to me!!

I had Barry Burns from Datsport install the box and he rang to tell me that there was no 5th gear after he took it out for a test drive. He then pulled the gearbox out, opened it up and hey its a 4 speed. So no it is not worn or broken.

Tells me that the box was worn right there. If it wasnt untill he put it in and he had to strip it to confirm it. Sounds like a worn box that the gearstick went into the fifth position.
Tough break.
I find it hard that you didnt even try selecting gears beforehand yourself and thought it to be a 5 speed.
Thats all I have to say on the matter.

Tough luck but as the topic says BUYER beware. its your decision to buy or not so check out the goods first. You've learnt an expensive lesson for next time.

Yeah it is an expensive lesson and I wish I had of tested it when I opened the crate but it had no lever so I didn't bother, I had to much else going on at the time. I will take the heat for that no worries, but I am still dark. I don't like dishonest people who want to hide behind legal opinion and bullshit instead of being upfront and reasonable.

At least I have the worlds most expensive 4 speed Sunny box in my ute!!

man that sucks! you definately need to cop the fact that you didn't check in time, but really should the fact you didn't change anything? if it was a busted fiver then i'd say too bad for you, but a four speed? from a guy who knows datsuns...

i reckon it'd be a good thing if the man himself would answer in this post.

Well shouldnt he have been able to tell if its a four or five speed buy looking at it?
Dont get me wrong im not having a dig at Barry Burns. But he obveously knows a bit about datsuns?
